    Calls Grow for Ban on Official Crypto Holdings

    WASHINGTON / RankWire.AI / – Democracy Defenders Action and Transparency International U.S., both ethics watchdogs, urged Congress to implement strict anti-corruption measures in upcoming cryptocurrency legislation or to abandon the CLARITY Act entirely. In a joint statement, these nonpartisan advocacy groups criticized the ethical framework of the proposed Digital Asset Market Clarity Act, warning that its current language leaves significant loopholes unaddressed. They emphasized that without enforceable bans on self-dealing by public officials, the bill cannot adequately protect American consumers, safeguard national economic stability, or secure the crypto marketplace.

    Legal specialists from both oversight organizations pointed out that the ethics provisions in the Senate draft were narrowly defined and included substantial statutory exemptions. The advocacy groups claimed that the draft allowed existing cryptocurrency holdings and financial arrangements to remain, while lacking effective enforcement mechanisms. They argued that this legislative language effectively shields pre-existing commercial ventures from federal oversight. To bring about meaningful reform, the watchdogs called for a comprehensive ban preventing all covered government officials from holding direct financial interests, engaging in digital asset trading, or profiting from pre-existing licensing and profit-sharing agreements.

    Core policy requirements outlined by the coalition focus on preventing public officials from leveraging federal digital asset oversight for personal financial benefit. The proposed ethics standards specify that covered officials and their immediate family members—including spouses and dependent children—must divest from all digital asset holdings, except those in diversified registered investment funds. Additionally, the groups urged strict rules to stop adult children of public officials from using family ties or proximity to power to promote commercial crypto enterprises. They also stressed that full financial disclosure must be mandatory for all digital asset transactions, including acquisitions, sales, and transfers, regardless of compensation.

    Scrutiny Mounts Over Loopholes in Senate CLARITY Act Language

    Regarding enforcement, the oversight groups emphasized that ethics rules require independent administrative authority to remain effective beyond individual presidential terms. They urged Congress to grant investigating authority to the Attorney General under an extended statute of limitations and to enable private actors and state attorneys general to pursue legal remedies against misconduct. Virginia Canter, chief counsel and director of ethics and anti-corruption at Democracy Defenders Action, stated that ethics legislation lacking independent enforcement mechanisms essentially greenlights corruption, urging Congress to enforce a total ban on digital asset interests for officials and their families.

    Economic analysts and policy experts highlighted that the broader debate over the CLARITY Act centers on defining jurisdiction over the digital asset industry. The legislation aims to establish clearer regulatory lines between federal market regulators, moving away from enforcement-heavy approaches of the past. However, ethics advocates underscored that protecting public trust demands strict boundaries between regulatory authority and private financial interests. Scott Greytak, deputy executive director at Transparency International U.S., remarked that the public expects officials to choose between regulating an industry or profiting from it, adding that lawmakers must close crypto conflict of interest loopholes or abandon the CLARITY Act to uphold government integrity.

    Eliminating Grandfather Clauses for Existing Investments

    As the Senate considers the bill, congressional leaders are under increasing pressure from ethics organizations to resolve conflicts of interest safeguards. Oversight experts warn that exempting pre-existing commercial relationships sets a dangerous precedent for federal ethics enforcement in emerging financial sectors. Representatives from both groups reiterated that removing these exemptions is the minimum necessary step to restore public confidence in federal oversight of markets.

    Whether the CLARITY Act advances will depend on whether committee negotiators include binding ethics requirements before the final floor vote. Congressional aides reported ongoing bipartisan discussions regarding potential amendments to the bill’s enforcement provisions. Ethics advocates cautioned that passing the legislation without comprehensive prohibitions on conflicts of interest would weaken regulatory credibility and perpetuate issues of favoritism within the federal government.
